Selling Used Cars as New

New means new. A new car is one that has never been previously titled, has not been sold to another purchaser, and does not have mileage accumulated beyond what expected in a normal retail environment.

New vehicles will have some miles on the odometer, this is unavoidable and acceptable under the law. A dealer can allow potential buyers to test drive a vehicle before buying, and this will not spoil the status of the vehicle. However, if a dealer sells a car and the vehicle is returned, it likely is no longer new. If a new car's pre-sale history is not disclosed before you purchase, you may have a claim.
